1. About NewPath Mutual
NewPath Mutual Insurance Company is a Utah-licensed group captive insurance company. Employer group health plans offered through NewPath Mutual are ERISA self-funded insurance plans administered by Redirect Health ("Plan Administrator" or "TPA"). Redirect Health and NewPath Mutual Insurance Company are separate legal entities.
2. Informational Purposes Only
The content on this Site is provided for general informational and marketing purposes only. It is not intended to constitute:
- A contract or guarantee of benefits
- An offer of insurance or a binding quote
- Medical, legal, tax, or financial advice
- A substitute for the actual Summary Plan Description (SPD)
All plan descriptions, benefit summaries, and pricing information on this Site are general overviews. Actual coverage details, limitations, exclusions, and terms are governed solely by the applicable Summary Plan Description (SPD) and plan documents provided upon enrollment. In the event of any conflict between the Site content and the SPD, the SPD controls.
3. Plan Pricing and Availability
Plan pricing shown on this Site reflects EverydayCARE® plan rates effective 10/1/2025 and includes a 6% broker commission. Rates are subject to change without notice. Plan availability may vary based on employer group size, location, and underwriting requirements. Individual medical questionnaires may be required for groups with fewer than 20 eligible employees.
The savings estimates, calculators, and comparisons presented on this Site are illustrative tools based on published market data (including the KFF Employer Health Benefits Survey 2024) and NewPath Mutual plan rates. Actual savings will vary based on workforce demographics, health profile, claims experience, and plan selection. No estimate on this Site constitutes a binding offer or guarantee of savings.
4. ACA Compliance Disclosures
EverydayCARE® Hospital and Hospital PLUS plans are designed to satisfy ACA Penalty A (Minimum Essential Coverage) and Penalty B (Minimum Value Plan). EverydayCARE® Routine Care is designed to satisfy ACA Penalty A (MEC) only. Compliance determinations depend on specific plan design and employer contribution levels. Employers should consult with their benefits advisor or legal counsel for compliance guidance specific to their situation.
5. Use of the Site
You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Site in any way that violates applicable federal, state, or local law
- Attempt to gain unauthorized access to any part of the Site, its servers, or connected systems
- Use the Site to transmit harmful code, spam, or unsolicited communications
- Reproduce, distribute, or create derivative works from the Site content without our written permission
- Use automated tools (bots, scrapers) to access the Site content

9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEWPATH MUTUAL INSURANCE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability for any claim arising out of or relating to these Terms or the Site shall not exceed the amount you paid to us (if any) in the twelve (12) months preceding the claim.

11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Utah, and you consent to the personal jurisdiction of such courts.
12. ERISA Preemption
To the extent that any content on this Site relates to employer group health plans governed by the Employee Retirement Income Security Act of 1974 (ERISA), such plans are subject to federal ERISA standards. Nothing on this Site is intended to modify, supplement, or supersede the terms of any ERISA-governed plan document or Summary Plan Description.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Site after any modifications constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and NewPath Mutual Insurance Company regarding your use of the Site and supersede any prior agreements or communications.
